Estate Administration

Dealing with the death of a loved one is extremely difficult. The wishes of the deceased are usually expressed in the Last Will which was made prior to the passing of that person. We are here to assist family members who have been included in the Will of the Deceased to make a smooth and sensitive transfer of assets of the deceased in accordance with the wishes expressed in the Will. In many cases an Application will need to be made to the Supreme Court for a Grant of Probate of the Will. We have extensive experience in assisting those named in the Will to receive their entitlement without undue delay and stress.

Sometimes a person may die without having made a Will. This is called an ‘intestacy’ and there are rules surrounding the way the estate is then distributed. We have assisted many families over the years to cope with the sometimes difficulty and stressful aspects of the Estate Administration.

Estate Litigation

If you believe that you have been unfairly left out of a Will, you may be legally entitled to contest the written wishes of your deceased relative, however, it is extremely important that you do so according to succession and family provision laws. You must give a Notice of your Intention to make such a claim within 6 months of the death of the relative.

We provide advice to you on who can make a family provision claim, the time restraints on making a family provision claim, how you can challenge or contest a Will, the procedures for litigation (if required) and the potential outcomes of your dispute.
